PRIVACY POLICY

- PRIVACY STATEMENT
Grabhub Inc., (hereinafter “Grabhub” or “we” “our” or “us”) appreciates your interest in our Services. When you use Grabhub, you entrust us with your personal information. We’re committed to keeping that trust and your privacy is important to us. This Privacy policy will inform you of the Personal information we collect, how that information is used, under what circumstances we may disclose information, and your rights. We recommend that you read this along with our Terms of service which highlights key points about our Privacy practices.
Grabhub is committed to protecting the rights of individuals in line with the Personal Information Protection and Electronic Documents Act (PIPEDA) (reference (S.C. 2000, c. 5), the General Data Protection Regulation (reference EU2016/679) of the European Parliament (“GDPR”) as well as each applicable national personal information protection laws and regulations”. We may also provide additional disclosures relating to the processing of personal information about residents of specific countries or regions.
- PERSONAL INFORMATION WE COLLECT
Personal information, also referred to as personal data, or personally identifiable information is any information that can be used to identify a person either directly or indirectly (“Personal information”). This definition covers a wide range of personal identifiers including name, address, email address, identification number, location data or online identifier. The Personal Information that we collect from you include;
2.1. Data provided by you
User profile information. At various points of using our service, you may provide us personal information. When you create an Account, log-in to your Account, update your Account profile, sign up for a mailing list, or otherwise communicate or interact with us (whether or not through an Account), we may collect information from you, such as your name, phone number, e-mail address, and home address.
Transaction information. When you place an order, we collect information, including but not limited to the items purchased, the date and time of your transaction. You may be required to provide payment information, such as your credit card, debit card or gift card details. We use this transaction information to fulfill your order, detect and prevent fraud, personalize your experience, and identify usage trends. Should you require support, we maintain all communications (including email, phone, mail and chat) resulting from your interactions with us. We use all the foregoing communications to address your questions, issues and concerns and provide other related customer support services, for safety and security purposes, and to improve our Services.
Other information you allow others provide us. If you chose to log into the Services through a third-party service, both we and that third-party may receive some information about you and your use of the Services. For example, if you sign up for the Services with your Facebook account, we may receive from Facebook, information such as your name, e-mail address, public profile information, and information about your contacts. We may receive personal information about you from third-parties and further process them with the information we collect through our Platform. We may also offer social sharing tools (such as the Facebook “Like” button) that let you share actions on the Services with other websites and vice versa. In those cases, the providers of those tools may receive information about you when you make use of those tools. The data we receive from these third-party sites is dependent upon that third party’s policies and your privacy settings on that third-party site. We do not have control over third parties that provide or process your personal information therefore, any information request regarding the disclosure of your personal information to us should be directed to such third parties.
If you wish to invite your friends through our friend referral program and other contacts to use the Services, you may either enter their contact information manually or import it directly from your address books on other third-party Services. In both cases, we will store this information for the sole purposes of allowing you to send your friends referral offers, for determining whether your friends use the Services after a referral is sent to them and, in some circumstances to remind your friends of the referral sent on your behalf.
We may also use aggregate personal information for market analysis, regulatory compliance, research, demographic profiling, marketing and other business purposes. When we do so, we ensure that the end-product does not uniquely identify you or any other user of the Platform and/or Services.
2.2. Personal Information Generated and/or Automatically Collected during your use of the Platform
Location Information. In some cases, we may collect precise location data when you use the Services. For example, if you allow your mobile application to access location Services through the permission system used by device’s mobile operating system, we collect your exact location, or we can approximate the location of your device through your IP Address. We use location information to customize content on our Platform, show you the Retailers that are closest to you and the deals they offer, facilitate order processing, detect and prevent fraud, and perform analytics. If you have previously opted into Grabhub’s collection and use of location-based information through our mobile application, we may collect and store the precise location of your device when the app is running on the background of your device. You may opt-out of this functionality by adjusting the settings on your mobile device or when prompted by Grabhub’s mobile app.
Pixels, Cookies, and other Tracking Technologies. We and our partners use various technologies to automatically collect information, including but not limited to flash objects, cookies, embedded scripts, mobile SDKs, and similar technology (collectively, “tracking technologies”). Cookies are small text files that are sent by your computer when you access our Services through a web browser. The Information we collect automatically about you or your device may be further processed with other personal data we collect directly to help us do things such as understand how you use our Services; remember your information submitted previously so you do not have to re-enter it during your next visit, understand your usage patterns; personalize your experience; manage, and display advertising on the Services; and diagnose or fix technology problems.
We may collect anonymized analytical data or use third-party analytics tools such as Google Analytics to understand how users interact with the Services; help us measure traffic and the demographics of our users in order to improve our Platform. Information about your device. We automatically receive some technical information about the hardware and software that is being used when you use the mobile application. This may include your IP address, operating system, browser type, internet service provider, device type/model/manufacturer, date and time stamp, and a unique ID that enables us to identify your browser, mobile device, or your Account (for example, a persistent device identifier), and other similar information. We use this information to run diagnostics and fix technological problems and improve our Services.
- The Basis for processing of your Personal Information
In compliance with the applicable law, we need a lawful basis for collecting and/or processing your Personal Information. We generally rely on a number of grounds (basis) for our business processing. The purposes for processing your Personal information are:
- To comply with contractual obligations: we will process your Personal information so that we can provide that product or service to you.
- As a result of your consent you provided the moment you agreed to our Terms of service
- On the basis of Legal obligations or in the public interest.
- Within the scope of a legitimate interest: In certain circumstances, we may not need your permission to use your Personal information, (for example: to prevent and investigate criminal acts) given our legitimate interest to do so, but we must inform you when we do this.
4. How We Use Your Personal Information
In addition to the uses identified above, we may collect and use personal information for various purpose, including to;
- Provide, maintain, and improve the quality of Services we offer.
- Test and develop new features and functionality and otherwise enhance the experience of our Services.
- Process your orders and charge you for the purchase through one or more payment processing partners.
- Maintain the safety, stability and security of our Platform and Services.
- Conduct security investigations, risk assessments and enforce our security measures.
- Provide customer support, respond to your communications and request, and inform you of important new features or changes.
- Provide, personalize, measure, and improve customized content.
- Comply with applicable laws and other regulatory compliance obligations.
- Monitor, investigate, prevent, and/or mitigate violations of our Terms of Service.
- Fulfill any other business or commercial purposes at your direction or with your consent.
5. What we share
Grabhub is an on-demand grocery shopping platform that facilitates the purchase of discounted food items, groceries, and other home essentials with a near expiration date or a dent on the packaging. Our eco-friendly business model allows shoppers save money by presenting them with groceries that are still safe to consume at much affordable rates and save the planet by reducing food waste. The Services present you with a set of one or more Retailer virtual storefronts nearby that offers such goods for in-store pick up. To provide and maintain this service, we need to share information about you and your order with the third parties who help enable the service. This includes the payment processing partner(s) that we use to validate and charge your credit card, and the retail partner(s) from whom you purchase goods. Be assured that only our payment processing partner(s) receive your credit or debit card information.
With your consent or at your direction, we will share your information with entities outside of the Services when it is done at your direction. For example, if you invite friends to use the Services through our referral program, we may share some information with the friends you invite.
We share your information for the following purposes:
- Merchant Sharing. We disclose personal information to the Retailers you order from, and third parties engaged by those Merchants (e.g., point of sale providers or their own delivery personnel), as needed to fulfill your orders
- For external processing necessary to enable you use the Platform. We sometimes disclose personal information to other third parties as needed to provide certain Services, including, without limitation, payment processors, customer service, analytics provider, advertising Services and delivery providers.
- For legal purposes. We may disclose your information when we believe that such action is reasonably necessary to (a) comply with applicable laws, regulations, legal process, or reasonable requests from law enforcement authorities, (b) prevent, detect, or otherwise handle fraud, security, or technical issues, and (c) protect the rights and safety, or property of any person, the public, or Grabhub, (d) enforce our Terms of Service or to protect the security or integrity of our Services.
- Social networks. We disclose personal information, such as a unique identifier, hashed email address, or information automatically collected through tracking technologies, to social networks for the purpose of displaying personalized ads and content on those social networks.
- For Business Purposes. We may be involved with a corporate reorganisation, such as a merger, acquisition, joint venture, or financing or sale of all or a portion of company assets. We may share your personal information to a third-party during negotiations in connection with, or as an asset in such a corporate reorganisation. Personal information may also be disclosed in the event of insolvency, bankruptcy, or receivership.
6. How We Store and Protect Your Information
Data storage and transfer. Grabhub is located in Canada and some of its service providers are located in the United States or elsewhere outside of Canada. As a result, your personal information may be stored and processed outside of Canada for the purposes described in this Privacy Policy. The file containing your personal information will be maintained on the servers of our service providers and will be accessible by our authorized employees, representatives and service providers who require access for the purposes described in this Privacy Policy. To be clear, your Personal information will be subject to applicable local laws, which may permit government and national security authorities in jurisdictions where your data is stored or transferred to access your personal information in certain circumstances.
Keeping your information safe. We care about the security and safety of your information. We employ physical, administrative, and technological safeguards designed to preserve the integrity and protect all information under our control from unauthorized disclosure. We will make any legally required notifications of any breach of the security, confidentiality or integrity of your personal information without unreasonable delays.
You can contribute to the safety of your personal information. We strongly recommend that you change your passwords often, use a combination of letters and numbers, make sure you use a secure browser, and otherwise take precautions when communicating your personal information on the internet. If you know or have reason to believe that your Account credentials have been stolen or otherwise compromised or in case of any actual or suspected unauthorized use of your Account, please contact us.
7. Control over Your Personal Information
How to control your communications preferences. You can opt-out of receiving promotional communications from Grabhub by using the settings on the account Profile page or by utilizing the Instructions and/or “unsubscribe link” included in the message, where applicable. You may not opt out of service-related communications (e.g., Account verification, transactional communications, changes/updates to features of the Services, technical and security notices). Please see our Terms of Service for more information on communications from or on behalf of Grabhub.
Access to your Device Information and Push Notifications. You may control access to your device information or opt out of push notifications through the “Settings” app on your mobile device. For instance, you can withdraw permission for the app to access your location data through your device settings, though we may continue to approximate your location based on your IP address or through other means.
- Your rights and how to exercise them
You may at any time exercise your data protection rights which includes:
- Right to correct Personal information. You have the right to change any inaccurate Personal information concerning you.
- Right to be forgotten. In some cases, for instance, when the personal information is no longer necessary in relation to the purposes for which they were collected, you have the right for your Personal information to be erased.
- Right to restrict the processing of your data. In such cases, your Personal information will only be processed with your consent or for the exercise or defense of legal claims.
- Right to object and to withdraw consent. You may lose access to the Service if you do so.

9. Region Specific Disclosures
We may choose or be required by law to provide different or additional disclosures relating to the processing of personal information about residents of certain countries, regions or states. Please refer below for disclosures that may be applicable to you:
- California. If you are a resident of the State of California in the United States, the California Consumer Privacy Act of 2018 (“ CCPA ”) provides additional rights to know, delete and opt out, and requires businesses collecting or disclosing personal information to provide notices and means to exercise those rights. You may also ask for a notice describing what categories of personal information we share with third parties, and identify the name and address of the third parties. You can exercise any of these rights by contacting us. If you chose to opt-out, please use the subject line “California opt-out”
- Nevada. If you are a resident of the State of Nevada, Chapter 603A of the Nevada Revised Statutes permits a Nevada resident to opt-out of future sales of certain covered information that we have collected or will collect. To submit such a request, please contact us at contact us with the subject line “Nevada opt-out.”
- Changes to this Policy
We may occasionally update this policy. If we make significant changes, we will notify users in advance of the changes through the apps or other means, such as email. We encourage users to periodically review this notice for the latest information on our privacy practices.
